How do you instantly protect real estate, intellectual property or
brokerage accounts?
Delaware LLC & Intellectual Property: File the
copyright or patent in the name of the LLC, or assign the rights of the
copyright to the LLC, in exchange for the member interest.
Delaware LLC & Real Estate: Title the real estate
property in the LLC. Alternatively, the LLC can place a lien
against the real estate in exchange for the member interest.
Delaware LLC & Brokerage accounts: Place the
brokerage account in the LLC in exchange for an interest in the LLC.
You and family are members of the LLC.
The goal is to transfer the property, or an
interest in the property itself, to the LLC, in exchange for the member
interest.
Transferring a property interest to the LLC or
"fair market value" is difficult to contest, in terms of
fraudulent conveyance. The creditor is only left with a charging
order when the manager is restricting the LLC distributions.
